When You Can Cancel Without Penalty
ISP contracts include early termination fees (ETFs) ranging from $150 to $400. Most people believe these fees are unavoidable. In reality, there are multiple legitimate grounds to break an ISP contract without paying ETF:
Ground 1: ISP Changed the Terms (Most Common)
If your ISP raised your monthly price, added a new fee, changed their data cap, or reduced a service level after you signed your contract, this constitutes a material change in terms. Most ISP contracts include a clause granting you the right to cancel without penalty if you object to a material change within 30–60 days of notification.
When Comcast or AT&T mails you a "service update" notice — read it. If any price or service condition changed, use that notice as grounds to cancel fee-free. Then state: "I am canceling because you materially changed the contract terms per [terms of service section]."
Ground 2: Failure to Deliver Advertised Speeds
Document speed test results consistently below 50% of advertised speed over 2–4 weeks. Contact your ISP in writing requesting service correction. Give them 30 days to resolve. If they fail, you have documented grounds for cancellation due to breach of service agreement. Attach your DCSpeedTest screenshots to the cancellation request.
Ground 3: Service Outages Exceeding SLA
Most ISP residential contracts include a Service Level Agreement (SLA) specifying uptime guarantees (typically 99.5–99.9%). Prolonged outages that clearly exceed SLA terms can justify cancellation without ETF, especially if you have kept an outage log.
Ground 4: Moving to an Unserved Area
If you move to an address where your ISP does not offer service, virtually all major ISPs will waive the ETF. Get confirmation in writing before your move date.
The Script That Works
When calling to cancel, say: "I am canceling my service. The reason is [material change / speeds below contracted level / unserved area]. I am requesting you waive the early termination fee based on [specific reason]. Please confirm the waiver in this call and send written confirmation to my email." Do not ask if you can cancel without fees — state that you intend to and reference the specific contractual basis.
